Form I-9 Employment Eligibility Verification Services are offered as a Non-Notary Service.

An Employer Agent is a person, company or other entity that is providing the Employment Eligibility Verification Service of verifying employees as a third party to employers.

Contrary to popular belief the Form I-9 does not require notarization, so a Notary Public cannot affix his or her notary stamp to this document. In fact, it is illegal for a notary to do so!

When serving as an authorized agent for an employer the Notary Public is prohibited from attesting that he or she is a Notary Public.

According to the Department of Homeland Security – U.S. Citizenship and Immigration Services, employers may “designate an authorized agent (including personnel officers, foremen, agents or notary public) to fill out Forms I-9 on behalf of their organization.”

If a notary public is hired, the notary public is acting as an authorized agent of the employer, not as a notary. The notary public must perform the same required actions as an employer representative. When acting as an authorized agent, the notary public shall not provide a notary seal on Form I-9.
